Terms of Service

These Terms of Service (the “Terms”) govern your use of Job Genkan (the “Service”), a recruiting platform that connects software engineers with companies hiring engineering talent in Japan. The Service is primarily provided to companies that recruit through it; it is also used by engineers who create candidate profiles. By registering for, accessing, or using the Service, you agree to be bound by these Terms.

1. Agreement to These Terms

These Terms form a binding agreement between you and Job Genkan (the operator of the Service, referred to as “we,” “us,” or “our”). Where you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization, and “you” refers to both you and that organization.

If you do not agree to these Terms, you may not use the Service. We may also require you to agree to additional terms for certain features, which apply in addition to these Terms.

2. Definitions

  • “Candidate” means an engineer who registers for the Service to create and publish a candidate profile.
  • “Company” means a business that registers for the Service to search for, evaluate, and contact Candidates.
  • “User” means any Candidate, Company, Company user, or visitor who uses the Service.
  • “Content” means profiles, messages, files, and other information that Users submit to or through the Service.
  • “Scout” means a contact or message sent by a Company to a Candidate through the Service.

3. The Service

The Service lets Candidates present their skills, Japanese-language ability, visa and residency status, work history, and preferences, and lets Companies search candidate profiles and Scout Candidates. The Service also provides supporting tools, such as Japanese-format resume generation and a take-home pay calculator.

The Service facilitates introductions between Candidates and Companies. We are not a party to, and are not responsible for, any employment relationship, contract, interview, or hiring decision between a Candidate and a Company.

4. Eligibility and Registration

To use features that require an account, you must register and provide accurate, current, and complete information, and keep it up to date. The Service is intended for working professionals and organizations; it is not directed to individuals below the age of majority.

Companies may register for and use the Service only if the company is based in Japan, or the position or positions for which the company recruits through the Service are based in Japan. By registering as a Company, you represent and warrant that you meet this requirement. We may refuse or revoke a Company registration that does not.

We may refuse, approve, or revoke registration at our discretion, including where we are unable to verify a Company or where we reasonably believe registration information is false.

5. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized use. You may not share, transfer, or allow others to use your account except as expressly permitted for authorized Company users.

6. Candidates: Profiles, Content, and Visibility

Candidates are responsible for the accuracy of the information in their profile and other Content they submit. Candidates control the visibility of their profile and may publish it, limit it, or keep it as a private draft, as described in the Service and in our Privacy Policy.

Candidates grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display their Content as necessary to operate and provide the Service, including displaying profiles to Companies in accordance with the Candidate’s chosen visibility settings.

7. Companies: Use of the Service and Candidate Information

Companies may access and use candidate information only to evaluate and contact Candidates for legitimate recruiting purposes. Companies must handle candidate information appropriately and in accordance with applicable law and our Privacy Policy.

No data exfiltration. Candidate data is made available solely to evaluate and contact individual Candidates for specific roles through the Service. Companies must not scrape, crawl, harvest, copy, export, store, or otherwise extract candidate data from the Service — whether by automated means (such as bots or scripts) or manually — beyond what is necessary to contact an individual Candidate about a specific role, and must not build or contribute to any database from candidate data obtained through the Service.

On-platform contact first. Companies must initiate contact with a Candidate through the Service by sending a Scout. A Company must never contact a Candidate, through any channel, before that Candidate has been scouted through the Service. A Company may communicate with a Candidate outside the Service only after scouting the Candidate through the Service, and only where the Candidate has consented to, or has themselves initiated, that off-platform communication.

  • Do not use candidate information for any purpose other than recruiting for your own organization.
  • Do not disclose, sell, or provide candidate information to third parties.
  • Do not scrape, crawl, harvest, export, or otherwise extract candidate data from the Service, or retain it beyond what is necessary to contact an individual Candidate about a specific role.
  • Do not contact a Candidate before they have been scouted through the Service.
  • Do not contact Candidates outside the Service without the Candidate's prior consent or initiation.
  • Do not use the Service to send spam, solicitations unrelated to recruiting, or unlawful, discriminatory, or misleading communications.
  • Do not attempt to circumvent Scout-ticket limits, visibility controls, or other access controls.
  • Comply with applicable laws regarding employment, recruiting, and the protection of personal information.

8. Fees and Payment

Access to paid Company features requires a subscription and, where applicable, the purchase of Scout tickets, at the fees presented to you at the time of purchase. Unless stated otherwise, fees are stated exclusive of consumption tax and other applicable taxes, which you are responsible for paying.

Subscriptions renew automatically for successive periods unless cancelled in accordance with the Service. Except as required by applicable law, fees already paid are non-refundable, and we do not provide refunds or credits for partial periods or unused Scout tickets. We may change our fees prospectively by notifying you in advance.

9. Prohibited Conduct

You agree not to:

  • Violate any applicable law or regulation, or infringe the rights of others.
  • Submit false, misleading, or fraudulent information, or impersonate any person or organization.
  • Post or transmit content that is unlawful, defamatory, discriminatory, obscene, or otherwise objectionable.
  • Interfere with or disrupt the Service, or attempt to gain unauthorized access to it or to other accounts or systems.
  • Use bots, scrapers, or other automated means to access, collect, or copy data from the Service without our prior written consent.
  • Use the Service or any information obtained through it for any purpose other than its intended recruiting use.

10. Intellectual Property

The Service, including its software, design, text, and other materials we provide (excluding User Content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. You retain your rights in the Content you submit, subject to the licenses granted in these Terms.

11. Suspension, Termination, and Withdrawal

You may stop using the Service and request deletion of your account at any time as described in the Service and our Privacy Policy. We may suspend or terminate your access, in whole or in part, if you violate these Terms, if required by law, or if we reasonably consider it necessary to protect Users or the Service.

Provisions that by their nature should survive termination — including those on fees already due, intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive termination of these Terms.

12. Disclaimers; No Guarantee of Hiring

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, and we do not guarantee any particular outcome, including that a Candidate will be hired or that a Company will find or successfully recruit any candidate. We are not responsible for the conduct, statements, or qualifications of any User, or for the truth or accuracy of any Content.

13. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business, arising out of or relating to the Service.

Our total liability for all claims arising out of or relating to the Service is capped at the total fees you paid us for the Service in the three (3) months immediately before the event that gave rise to the claim. If you have not paid us any fees — for example, Candidates, who use the Service free of charge — that cap is JPY 10,000.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability arising from our willful misconduct or gross negligence.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your Content, or your violation of these Terms or of applicable law or the rights of others.

15. Handling of Personal Information

We handle personal information in accordance with our Privacy Policy, which forms part of these Terms. Please review it to understand how we collect, use, share, and protect personal information.

16. Changes to the Service and These Terms

We may modify, suspend, or discontinue all or part of the Service at any time. We may also revise these Terms from time to time. When we make material changes, we will post the updated Terms on this page and revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

17. Notices and Communications

We may provide notices to you through the Service or by email to the address associated with your account. You agree to receive communications from us electronically, and you are responsible for keeping your contact information current.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any dispute arising out of or relating to the Service or these Terms will be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance, to the extent permitted by law.
